Were these fellows in the German military?  If so, then, yes, they were
legal targets until such time as they actually surrendered.

The system I have set out is the state of the law under the United States'
UCMJ.  I served for quite a few years under the UCMJ and was quite content
to do so.  What military service did you serve in, Ron?  I suspect they had
a parallel provision.
